Name Change Law and Procedures

Month-To-Month Tenants in New York City Not Required By Statute to Provide Notice of Intent to Vacate

If a tenant remains in the Premises after the term of the tenant's lease, and the landlord has accepted rent during the period after the expiration of the tenancy, the tenat has a "month-to-month" tenancy. Pursuant to New York's Real Property Law, Section 232, a month-to-month tenancy may be terminated by the landlord through service of a "Thirty Day Notice".

The Thirty Day Notice must be served at least thirty (30) days prior to the intended date of expiration and last day of month.
